Benue: Senate approves restoration of Mata, Mbagwa, Agasha Constituencies

…Passes payments to determine two Federal Universities

The Senate on Wednesday accredited the restoration of Mata and Mbagwa State Constituencies from the Ushongo Constituency as directed by the Federal Excessive Courtroom.

This was simply because it accredited the restoration of Agasha State Constituency by altering the boundaries of the present Guma State Constituency to create two State Constituencies.

They’re: Agasha State Constituency comprising of Saghev, Ndzorov, Kaambe and Abinsi council wards, and Guma State Constituency comprising Uvir, Mbadwem, Mbabai, Mbawa, nyiev and mbayer/yandev council wards.

The approval for the restoration of Mata State Constituency from Ushongo State Constituency comprise of: Ikov (2); Mbagwa (07); Mbagwaza (08); Mbayegh (10); and Uange (11).

Additionally, the approval for the restoration of Mbagwa State Constituency from Ushongo State Constituency comprise of: Artikyese (01); Lessel (03); Mbaaka (04); Mbaanyam (05); Mbaawe (06); and Mbakuha (09).

The Senate, accordingly, urged the Unbiased Nationwide Electoral Fee (INEC) to adjust to its decision, and impact identical within the subsequent State Homes of Meeting election after the present lifetime of the Benue State Home of Meeting in compliance with Part 115 of the 1999 Structure (as amended).

These had been resolutions reached sequel to the consideration of a movement sponsored by Senator Gabriel Suswam (PDP – Benue North East).

Suswam in his movement, famous the choice of the Federal Excessive Courtroom Abuja on thirteenth of January 2005 within the case of Ushongo Authorities v. INEC swimsuit No. FHC/ABJ/CS/562/2004 which ordered the unbiased Nationwide Electoral Fee to revive the suppressed Mata and Mbagwa State Constituencies in Ushongo Native Authorities of Benue State.

Guma LGA swimsuit No. DC/195/2016 whereby the apex courtroom affirmed the choice of the Courtroom of Attraction delivered 16/06/2015 in swimsuit No. CA/MK/137/2012 on the fast restoration of Agasha State Constituency within the Native Authorities of Benue State.

“Remembers that sequel to the stated choices of the Federal Excessive Courtroom and that of the Supreme Courtroom on the restoration of the Mata, Mbagwa and Agasha State Constituencies respectively, and upon request of the Home of Representatives and the Senate on 14th Might 2019, and Might 28, 2019 each chambers of the eighth Nationwide Meeting handed a concurrent decision unanimously approving the restoration of two State Constituencies of Mata and Mbagwa from Ushongo State, and the restoration of Agasha State Constituency from Guma Native Authorities Space of Benue State in compliance with the order of the courts and the supply of Part 115 of the Structure of the Federal Republic of Nigeria, 1999 as amended.

“Remembers additional that because of the dissolution of the eighth Nationwide Meeting, it’s concurrent decision on restoration of the 2 suppressed state constituencies from Ushongo State Constituency and the restoration of Agasha State Constituency from Guma native governments couldn’t be transmitted to INEC for implementation therefore the necessity for an additional decision to approve the train as ordered by the Courts and in compliance with Sections 91 and 115 of the 1999 Nigerian Structure;

“Observes that the delay in complying with the order of the Federal Excessive Courtroom in Swimsuit No. FHC/ABJ/CS/562/2004 and that of the Supreme Courtroom in Swimsuit No. SC/195/2016 on the restoration of Mata and Mbagwa State Constituencies from Ushongo State Constituency and Agasha State Constituency from Guma State Constituency of Benue State is a severe constitutional aberration in opposition to the spirit of Part 91 and 115 of the 1999 Nigerian structure and has through the years unjustly denied the individuals of Mata, Mbagwa and Agasha of their due illustration within the Benue State Home of Meeting,” Suswam stated.

In the meantime, the Senate throughout plenary on Wednesday handed two payments to determine the Federal College of Environmental Know-how, Saakperwa Tai Ogoni, Rivers State; and the Federal College of Agriculture and Know-how, Oke-Ogun, Oyo State.

The passage of each payments adopted the consideration of the studies of the Committee on Tertiary Establishments and TETFUND, Chaired by Senator Ahmad Baba Kaita (APC – Katsina North).
